Civil Division General Filing Requirements

The Summit County Court of Common Pleas Civil Division Requires Mandatory E-Filing.

 
Wage Garnishments and Bank Attachments

All forms are provided by the Clerk's Office website. Bank Attachments have a filing fee of a $120, with a $119 check made payable to Summit County Clerk of Courts and a $1.00 check made payable to the bank. Wage Garnishments have a filing fee of $120 made payable to the Summit County Clerk of Courts. All Garnishments are to be filed over the counter or by mail.

 
Mandatory Orders/Proceedings in Aid of Execution

Mandatory e-filing with a fee of $120. Instructions for service, motion and affidavit, and an order must be uploaded in Microsoft Word format in proposed orders. All are required documents.

 
Subpoenas

Forms are provided by Clerk's Office website. The original is required for filing. One witness per subpoena and Instructions for service are required. E-Filing of the return is required on the Clerk's office docket when served by counsel.

 
Judgment Liens

New Judgment Lien filings cost $55.50. Praecipe to file Judgment Lien is required. Form provided by the Clerk's Office, call 330-643-2211. Copy of Judgment is required.

 
Transfer of Judgment Lien

Transfers cost $5.00. Copy of Judgment is required. Praecipe to Transfer Judgment Lien is required. Form provided by the Clerk's Office, call 330-643-2211.

 
Judgment from Another Court

Cost is $55.50. Certificate of Judgment Lien from other court jurisdiction is required.

 
Release of Ohio Department of Taxation, Bureau of Workers Compensation, Child Support, City of Akron, and Juvenile Liens

The cost of releasing Ohio Department of Taxation, Bureau of Workers Compensation, Child Support, City of Akron, and Juvenile Liens is $60.50. Personal checks, debit cards and/or credit cards are not accepted for Ohio Department of Taxation lien releases. Cash, money order, certified checks and business checks are accepted. Original Release prepared by the State Agency is required. Original Release to be kept by the Clerk; a copy will be provided to taxpayer. If filing by mail, please provide a return address and stamped envelope to receive a copy of the release.
